EV Crew Auto — Service Agreement

Version: SA-v3 · Effective date: November 1, 2026

This Service Agreement governs services provided under the business name EV Crew Auto ("EV Crew", "we", "us"), Automotive Repair Dealer registration 318180. Acceptance of this Agreement at booking is separate from authorization of the specific job. Each job has an Estimate, Authorization, Work Order, Report and Invoice linked by a Transaction ID. The authorized Estimate/Work Order identifies the particular Vehicle, scope, price and payment option.

1. Parties and definitions

1.1 Provider. EV Crew Auto, Automotive Repair Dealer registration 318180. Telephone: (650) 278-3045. Email: hello@evcrewauto.com. EV Crew Auto is a business name, not a separate corporation or limited-liability company. The name and address registered with the Bureau of Automotive Repair appear on your Invoice and are available on request.

1.2 Customer. The person booking and authorizing the service. The Customer may be a prospective buyer rather than the Vehicle's owner.

1.3 Owner/Seller. The owner or seller with authority to permit inspection and operation of the Vehicle. The Customer must not represent that buying an inspection gives them ownership or driving authority.

1.4 Vehicle. The vehicle identified in the Estimate and Work Order by year, make, model, VIN and odometer reading.

1.5 Inspection and Report. The Inspection is the specific authorized assessment. The Report records the work actually performed, results, evidence and limitations.

1.6 Transaction ID. The identifier linking the job's documents and authorization communications.

1.7 Item status. Each report item is marked: - Inspected: checked using the method identified in the Report; this does not necessarily mean satisfactory condition. - Not Inspected: outside the purchased scope or not performed, with the reason stated. - Unable to Verify: an included item could not be verified because of access, safety, Vehicle capability or another documented limitation.

An untested or unverified item is never represented as having passed.

2. Scope of the Inspection

2.1 Assessment, not guarantee. The service assesses the Vehicle at the inspection time. It is not a vehicle warranty, insurance policy, valuation or recommendation to complete a purchase.

2.2 Launch packages — Tesla vehicles.

Item EV Inspection — Base EV Inspection — Pro
Service price US$ 200 US$ 380
Visual inspection Body and interior; paint thickness measurements; tires and brakes externally; visual underside examination subject to safe lifting/access Everything in Base
Diagnostic readings Fault codes and alerts through Tesla Toolbox, when available for the Vehicle Same, plus Toolbox health tests available for that model within the authorized scope
Battery Data reported by the Vehicle; compatible 12 V battery test subject to safe access Same, plus a 10–15 minute Supercharger observation
Functional checks Functions while parked/in the parking area Same, plus a test route with the Owner/Seller driving
Photos Main findings Complete inspection photo set of accessible items
Report Within 24 hours Within 24 hours

Neither package includes a scheduled 15-minute call. Questions may be submitted in writing under Section 10.

2.3 Availability. Readings and health tests depend on the model, software, access and equipment compatibility. We identify the actual method and any unavailable test. We do not apply a 12 V test to a different low-voltage battery type. The scope must be checked before booking; the Report describes any remaining limitation. Pro price adjustments are in Section 9.11.

2.4 Non-invasive inspection and lifting. No panels, covers, trim or high-voltage components are removed or opened under these packages. The underside examination is visual only. A jack and stands may be used only with a safe, model-appropriate lifting/support arrangement at Tesla-designated points, following the applicable manufacturer procedure and equipment requirements. The ground must be firm and level, with adequate access and permission. We never lift on the battery pack or inspect underneath a Vehicle supported only by a jack. If safe support is unavailable, the underside is marked Unable to Verify. This Agreement is not a lifting procedure.

2.5 Exclusions. The packages do not include laboratory/full-discharge battery capacity testing, dismantling, repairs, software updates/coding, fault-code clearing, title/lien/ownership or VIN-authenticity verification, accident-history certification, odometer-history verification, valuation, warranty eligibility determinations, recall-completion verification, Smog Check or state safety certification. They do not guarantee detection of hidden, intermittent or future defects. Any service outside the package requires a separately described and authorized scope; an available Toolbox function is not automatically authorized.

2.6 Additional work. No additional work or charge may proceed without a revised description and price and the Customer's recorded prior authorization. No repair is included merely because the Report recommends further investigation.

3. Condition at time of inspection

3.1 Snapshot. Findings reflect the date, time, location and conditions of the Inspection, only for the items and methods identified. The Vehicle may change afterward.

3.2 Limitations. Lighting, weather, dirt, access, temperature, charge level and information made available can affect the assessment. Relevant limitations are documented rather than treated as satisfactory findings.

3.3 Check-in/check-out. We record the odometer, visible existing damage, displayed alerts and relevant charge information, with photographs where appropriate, before and after the work. These records remain linked to the job.

4. Battery health and diagnostic limitations

4.1 Source and method. The Report distinguishes Vehicle-reported readings, software-derived estimates and direct observations. Battery-health estimates are not laboratory capacity measurements. Missing or inaccessible information is not inferred to be normal.

4.2 Limits. Reported results may depend on software, tool limitations and conditions at testing. Absence of stored fault codes does not prove absence of defects. We do not guarantee remaining battery life, future range or degradation, future charging performance, or acceptance of a manufacturer's warranty claim.

4.3 Supercharger observation — Pro. The planned session lasts 10–15 minutes. The Owner/Seller drives to the charger and must authorize charging through the Tesla account associated with the Vehicle. The account holder pays Tesla. Charging behavior is an observation under those conditions, not a capacity test.

EV Crew deducts the documented energy charge only, up to US$ 10, from the Customer's service price. Idle, congestion/queue and other non-energy fees are not eligible. The deduction and supporting charge are recorded on the Invoice. If prepaid, the deduction is returned under Section 9.10. The credit benefits the Customer's service bill; it is not a separate payment to the Tesla account holder.

If charge is above 80% when the observation would begin, the charging item is marked Unable to Verify. This is EV Crew's assessment criterion, not a Tesla safety limit. Safety, access or equipment conditions can also prevent the session.

5. Independence

5.1 EV Crew is independent and does not represent itself as Tesla-affiliated, Tesla-authorized or Tesla-certified. Use of Tesla diagnostic software does not imply such status.

5.2 EV Crew is not a party to the vehicle sale and does not receive compensation from a seller, dealer or lender based on inspection results or completion of the sale. Purchase decisions remain the Customer's.

5.3 Findings must be supported by evidence and will be explained on request. No obligation to purchase repairs or other services follows from a finding.

5.4 Any subcontracted work requires prior disclosure and Customer consent. EV Crew remains responsible for its contracted service and, on request, identifies the subcontractor and location.

6. Customer responsibilities

6.1 Permission. Arrange Owner/Seller permission for access, diagnostic connection, lifting and any drive or charging session. We may verify permission directly. Purchasing this service alone does not authorize use of someone else's Vehicle or account.

6.2 Availability. Arrange the Vehicle, keys/access and the person authorized to provide permission at the agreed time and safe location. Provide accurate contact and Vehicle information, and disclose known warnings, collision, flood, fire or battery damage/work.

6.3 Arrival charge — EV Crew policy. Base requires at least 20% state of charge. Pro requires 20%–50%, inclusive, and sufficient range to reach the selected Supercharger. These are EV Crew booking criteria, not a representation of Tesla's general inspection requirements. They do not replace prerequisites for a particular manufacturer diagnostic procedure. Above 80% at the charging observation, Section 4.3 applies; 51%–80% is not within the Pro arrival window. If arrival criteria are not met, we record the limitation and explain the possible scope and applicable price adjustments before proceeding.

6.4 Site safety. Follow reasonable safety instructions and keep children and pets away from the work area.

7. Road test authorization

7.1 Separate consent. The Customer and Owner/Seller must separately authorize the test route and charging-related travel in the Work Order. Record names, date/time and the designated driver. Without required consent, no drive occurs; the Report records non-performance and its reason, using the appropriate item status.

7.2 Driver. EV Crew personnel do not drive on public roads. The Owner/Seller, with a valid license and authority to operate the Vehicle, drives the test route and travel to the Supercharger. The technician observes as a passenger. EV Crew may conduct low-speed functional checks in the parking/private area only with permission and appropriate coverage.

7.3 Responsibility. Nothing in this Agreement promises that any insurance policy covers a particular event. Each party remains responsible as provided by applicable law. Customer consent does not excuse EV Crew's own actionable conduct.

7.4 Record and safety. The Report records whether the drive occurred, approximate route/distance and conditions. Either the driver or technician may stop it for safety. No mention of a completed drive means no drive was completed.

8. Safety and stop-work

8.1 EV Crew may decline or stop work reasonably considered unsafe or not possible to perform properly, including suspected high-voltage damage, unsafe surroundings, inadequate support/access or refusal of required permission. No one must continue an unsafe test to avoid a fee.

8.2 For an immediate hazard we withdraw, warn those present and recommend emergency or manufacturer roadside assistance when appropriate. The Inspection does not include making a damaged high-voltage system safe.

8.3 Safety-stop and partial-service charges. When the cause is not EV Crew's fault: - Visit without a completed inspection, or less than half completed: US$ 75. - Half or more completed, except the near-complete category below: 50% of the service price. - Everything except one or two included items completed: full service price, identifying those unavailable items as Unable to Verify with reasons.

The near-complete category is the specific exception to the half-or-more category. The Pro-specific adjustments in Section 9.11 must also be considered; inability to perform the designated Pro activities must not be hidden under the near-complete rule.

Completion measurement and overlapping adjustments. Use a fixed checklist for the purchased package, with equally weighted items identified before the appointment. Measure completion by completed items, not elapsed time; do not split or redefine items after the Inspection to change the price. The checklist version must be linked to the Work Order.

Where both partial-service pricing and Section 9.11 apply, calculate each separately against the original package service price and charge the lower resulting service price. Do not apply one reduction to the already reduced result of the other. Eligible Supercharger energy credits and late-Report deductions remain separate.

If the visit occurred and interruption was not caused by EV Crew, add only the travel charge previously disclosed and authorized under 9.2. If EV Crew caused the failure or cancelled, charge no travel fee. Cancellation/no-show fees do not have a travel fee added to them.

If the failure to complete is caused by EV Crew, no service charge applies and prepaid amounts are refunded. This includes failure caused by our missing equipment or mistake; it is not a device for charging the Customer for our own failure.

8.4 Visit-fee credit. The US$ 75 safety-stop visit fee is credited toward a rescheduled inspection of the same Vehicle within 30 days. This is not an automatic credit for repeat cancellation/no-show fees.

8.5 Deliver the findings gathered as a clearly identified partial Report. Cancellation/no-show fees are governed by Section 9, not charged again as a safety-stop fee for the same event.

9. Pricing, payment, cancellation, no-show and refunds

9.1 Prices. Base US$ 200; Pro US$ 380. These are launch prices. Future changes do not alter an already authorized Estimate.

9.2 Travel. Included up to 25 miles from Belmont, California. Beyond that, US$ 1.50 per additional mile, one-way only. Disclose the distance and charge in the Estimate before authorization; no return-leg charge is added.

9.3 Tax and other fees. Applicable sales tax is itemized on the Invoice. No unapproved surcharge, returned-check fee or generic supply fee is added.

9.4 Payment. Payment is due at Report delivery by cash, check or Zelle. Card payment through Stripe is available only when your Estimate offers it; EV Crew does not store full card numbers or card security codes. A card payment counts as paid only after confirmation from Stripe. Payment is not a substitute for authorization of the specific job.

9.5 Invoice and authorization. Issue the Invoice at completion, even if payment is not yet due or received. Include the BAR registration, corresponding business name/address, service location and itemized work, including diagnosis and no-charge services. Record required authorization information. Any increase beyond the authorized Estimate requires prior recorded approval.

9.6 Timely cancellation. Notice 24 hours or more before the appointment is always free and does not count toward the late-cancellation/no-show count.

9.7 Late cancellation/no-show. A cancellation with less than 24 hours' notice and a no-show count together as events for the booking: - The first event is free and uses the single free rescheduling. - The second and each subsequent event costs US$ 75. No further free rescheduling is included. - A no-show occurs after 20 minutes of waiting when the Vehicle or the person needed for access/permission is unavailable. Customer absence alone is not a no-show if authorized access is available.

9.8 Vehicle sold before the visit. If notified at least 2 hours before the appointment, cancellation is free and the Customer chooses a credit or refund. This special free-cancellation exception does not count as a late event. With less than 2 hours' notice, apply the late-cancellation rule in 9.7.

9.9 EV Crew cancellation. If we cancel or cannot attend, the Customer chooses a replacement appointment or full refund. Such events do not consume the Customer's free rescheduling or count toward the fee.

9.10 Refunds. EV Crew issues refunds within 48 hours after the refund becomes due, using the original payment method. For original cash or check payments, refund by Zelle or cash, arranged with the Customer. A card issuer/bank may take additional time to post funds.

9.11 Pro activities unavailable because the Vehicle does not permit them. - Neither the fast-charging observation nor the test route can be performed: charge the Base price. - Exactly one of those two cannot be performed: deduct US$ 50 from the Pro price.

Record the reason and actual item status. These are alternatives, not cumulative discounts for the same missing activities. Other model-dependent Toolbox limitations are disclosed in the Report; no unsupported health test is promised. Where this overlaps with partial-service pricing, Section 8.3 applies.

9.12 Credits. The eligible Supercharger energy deduction is described in 4.3. The late-Report deduction is described in 10.1. Itemize applicable deductions; return an overpayment under 9.10 rather than retaining it as compulsory credit.

10. Report delivery, corrections and complaints

10.1 Delivery. Both packages include electronic delivery within 24 hours after Inspection completion. If we expect a delay, we notify the Customer before that deadline and provide an updated time. If delivery exceeds 24 hours, the Customer receives a US$ 25 service-price deduction, even if we provided advance notice. If prepaid, refund that amount under 9.10. No scheduled call is included.

10.2 Content. Identify the Vehicle, Transaction ID, technician, date/time/location, odometer, relevant conditions, methods, findings, photos, battery-data sources, explained fault codes, completed charging/driving checks and limitations. Use the item statuses in 1.7.

10.3 Questions. Answer questions in writing within 2 business days.

10.4 EV Crew errors — Customer's choice. If the Report contains an error made by EV Crew, the Customer chooses one of these contractual remedies: 1. Correction free of charge, with a dated revised Report identifying the change; or 2. Refund of the service price paid, issued under 9.10.

The choice belongs to the Customer, not EV Crew. The policy does not require an error to be “material” and does not automatically combine correction and refund. Notify us of the error within 30 days after Report delivery, identifying the issue and supporting information when available. A later differing finding alone does not prove error, because the Vehicle or test conditions may have changed.

Earlier versions and the complaint/outcome remain in our records. If we learn that a Report contains information that is inaccurate and relevant to safety, we will tell the Customer even if a refund was chosen. This section adds to, and does not reduce, any right you have under the law.

10.5 Complaints. Send to hello@evcrewauto.com with the Transaction ID. Acknowledge within 2 business days and provide a written response within 10 business days of receipt. Customers may contact the California Bureau of Automotive Repair at https://www.bar.ca.gov.

10.6 Report recipients. The Report is prepared for the Customer. It is not a transferable safety certification, and we make no promise to anyone else who relies on it. Sharing with sellers or other recipients requires authorization, subject to the lawful operational exceptions in Section 12.

11. Limitation of liability

11.1 No Vehicle warranty. No guarantee is offered for the Vehicle, its battery, future performance or the purchase transaction. This does not excuse deficient performance of EV Crew's own service.

11.2 Our service. We are responsible for performing the authorized work with reasonable care and skill and for our actionable conduct under applicable law.

11.3 Limit for Report errors. To the extent the law allows, our total liability for financial loss caused by an error in a Report is limited to the service price you paid for that inspection.

11.4 What the limit does not cover. The limit in 11.3 does not apply to personal injury, physical damage to property, gross negligence, fraud, willful injury, violation of law, or any right that cannot lawfully be waived. See California Civil Code §1668.

11.5 Your remedies. This Section does not reduce the correction or refund choice in Section 10.4. If a court finds any part of this Section unenforceable, the rest remains in effect.

11.6 Information supplied. The assessment depends in part on information and access supplied by the Vehicle, Customer and Owner/Seller. We document identifiable inconsistencies rather than treating this as a blanket release from reasonable care.

12. Data and privacy

12.1 Policy. The Privacy Policy at https://app.evcrewauto.com/privacy/ explains categories, purposes, recipients, retention, security and rights.

12.2 Inspection data. Relevant data include contact/permission information, Vehicle identification and odometer, service location, Vehicle photos, diagnostic/battery readings, authorization communications, Report and payment records. Avoid unnecessary personal screens, documents and identifiable bystanders in photos.

12.3 Sharing. No sharing of Reports or Vehicle data with sellers or unrelated third parties without Customer authorization, except legally required disclosure and necessary operational providers (such as secure storage or payment processing) under appropriate obligations. We do not sell personal information. Publication or marketing use requires separate permission and is not a condition of the service.

12.4 Statistics — separate copy without identification. Use a separate statistical dataset without names, contact details or license plates, and with VIN information removed or truncated. Truncation alone is not treated as proof of anonymity: also remove/generalize other identifying details and combinations, including precise locations, images or unique records where necessary. Do not attempt re-identification. Complete identifiable job records are kept separately, encrypted, under Section 13.

12.5 Accounts. We do not request or store the Owner's manufacturer-account password. Any required account access or permission must use an authorized process rather than password sharing.

13. Records

13.1 Under EV Crew's selected retention schedule, keep complete customer/job records encrypted for three years after the Customer's last service, linked by Transaction ID: Estimates, Work Orders, Invoices, signed documents and authorization messages, together with Reports/evidence. The last-service trigger is EV Crew's policy; the BAR minimum for required transaction records is at least three years. Provide lawful access for BAR inspection. Requests that never become a service have their personal contact fields purged 90 days after the request, subject to lawful retention exceptions.

13.2 At the scheduled purge, direct contact fields are replaced with a removal marker and an audit event records the action. This field-level purge is not a promise that all related files or personal information have been erased. Under the current plan, VIN and technical vehicle history remain; these are not automatically anonymous. A separate de-identified dataset is used for statistics. Deletion requests are applied to information not required to be retained; legally required records and legitimate preservation holds are exceptions. Temporary portal PDF availability is 30 days, with removal only after confirmed archival of the exact document in the main record system. Authorization links expire after 7 days; link expiry does not erase the authorization record.

13.3 Provide copies of signed documents when signed and maintain records of authorizations. Work Orders include the odometer and authorized specific job. Provide the mobile ARD notice/sign with the Work Order as required. Estimates and Invoices use plain language rather than unexplained technical acronyms.

14. Governing law and disputes

14.1 California law governs. Disputes are to be addressed in San Mateo County, California, subject to mandatory jurisdiction/venue rules. Small claims court remains available for qualifying claims.

14.2 Contact hello@evcrewauto.com for good-faith resolution using the complaint-response process in 10.5. This process does not prevent urgent relief, lawful court proceedings or agency complaints and does not shorten applicable legal time limits.

14.3 This Agreement does not impose mandatory arbitration or a class-action waiver.

15. General provisions

15.1 Versioning. The version accepted for the booking applies. Later changes apply to future bookings unless a lawful, expressly agreed change is documented.

15.2 Documents. This Agreement and the specific authorized Estimate/Work Order define the service. The separately provided Privacy Policy explains data handling; acknowledging receipt is not blanket consent to unrelated marketing or sharing.

15.3 Severability and waiver. An unenforceable provision does not invalidate the remaining lawful provisions. Failure to enforce a term on one occasion does not waive it generally.

15.4 Electronic records. By checking the box at booking, you agree to receive this Agreement, Estimates, Work Orders, Reports, Invoices and related notices electronically, for this booking. You can view them with a current web browser, a PDF reader and an email account. You may ask for a paper copy at no charge, and you may withdraw this consent at any time by writing to hello@evcrewauto.com, without fee. Withdrawal applies to future documents and does not undo authorizations already given. Please tell us if your email address changes.

15.5 Language. This Agreement is in English. If we negotiate a service with you primarily in Spanish, Chinese, Tagalog, Vietnamese or Korean, ask us and we will provide a translation before you sign.

15.6 Contact. EV Crew Auto · (650) 278-3045 · hello@evcrewauto.com · BAR 318180.

Separate authorizations. Accepting this Agreement does not authorize a specific job, Owner/Seller permission, driving or charging, or any sharing or marketing use. Each of these is recorded separately.
